Welcome to Colyvee. These Terms of Service (“Terms”) govern your access to and use of the Colyvee website, products, content, and related services (collectively, the “Services”).

Throughout these Terms, “Colyvee,” “we,” “us,” and “our” refer to Colyvee. “You” and “your” refer to any person accessing our website, purchasing or using our products, or otherwise using our Services.

By accessing our website, purchasing a product, or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Use of Our Website

You may use our website only for lawful purposes and in accordance with these Terms.

You agree not to misuse the website, interfere with its operation or security, attempt to gain unauthorized access to any portion of the website, use automated systems to improperly access or collect information from the website, or use our content or intellectual property without authorization.

However, actual colors and appearance may vary slightly due to differences in displays, photography, lighting, manufacturing, and other factors.

Product availability is not guaranteed.

3. Sensory Swing Safety and Intended Use

Colyvee sensory swings are recreational and sensory products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.

Always follow the instructions, warnings, weight limitations, installation requirements, and other safety information supplied with your product.

Children should use the sensory swing only with appropriate adult supervision.

The swing must be securely installed into a suitable structural support using appropriate mounting hardware and installation methods. The suitability and structural integrity of the installation location are the responsibility of the purchaser and/or installer.

If you are uncertain whether a ceiling, joist, concrete surface, mounting point, or other structure is suitable for installation, consult a qualified contractor or other appropriate professional before installing or using the swing.

Inspect the swing, mounting hardware, connectors, fabric, and attachment points before use. Do not use the product if any component is loose, damaged, excessively worn, improperly installed, or otherwise appears unsafe.

Unless expressly stated otherwise in the instructions accompanying your product, Colyvee sensory swings are intended for static or gentle swinging use. Spinning should occur only when the installation includes appropriate hardware specifically designed to permit rotational movement.

Use the product only as directed.

4. Installation

Proper installation is essential to safe product use.

You are responsible for ensuring that installation is performed correctly and that the supporting structure is suitable for the forces created during use.

Installation instructions provided by Colyvee are general product instructions and cannot account for every building material, structural condition, ceiling construction, or installation environment.

When professional installation or structural assessment is appropriate, you are responsible for obtaining assistance from a qualified professional.

Do not modify mounting hardware or use substitute components unless they are suitable for the intended application.

5. Orders and Purchases

Some Colyvee products may be purchased through third-party marketplaces, including Amazon.

Purchases made through a third-party marketplace are also subject to that marketplace's applicable terms, payment procedures, shipping policies, return policies, and other conditions.

We reserve the right to refuse or cancel an order when permitted by applicable law, including in cases involving suspected fraud, pricing or listing errors, product unavailability, or unauthorized resale activity.

Prices and promotions may change without notice.

Prices displayed on third-party marketplaces are controlled by the applicable listing and may differ from prices or promotional information appearing elsewhere.

Taxes, shipping charges, and other applicable fees may be added where required.

If a pricing or product-information error occurs, we reserve the right to correct the error and take appropriate action consistent with applicable law and marketplace requirements.

7. Shipping and Delivery

Shipping estimates are estimates and are not guarantees unless expressly stated otherwise.

If you purchased a Colyvee product through Amazon or another third-party seller, you may be required to initiate your return through that marketplace.

The Colyvee name, logo, product imagery, graphics, instructional materials, videos, website design, written content, and other original materials are owned by or licensed to Colyvee and are protected by applicable intellectual-property laws.

Except as permitted by law or with our prior written authorization, you may not reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from our protected materials.

You may use product instructions and other materials supplied with a purchased product for your personal use of that product.

10. User Content and Communications

If you voluntarily submit a product review, photograph, testimonial, suggestion, feedback, or other content to Colyvee, you represent that you have the right to provide that material.

We will not use customer photographs, videos, or testimonials in advertising in a manner requiring authorization without obtaining the rights or permissions required by applicable law.

Feedback and suggestions regarding our products or Services may be used by Colyvee to improve our products and business without an obligation to compensate you, unless otherwise agreed in writing.

Colyvee is not responsible for injury or damage resulting from improper installation, use contrary to product instructions or warnings, unauthorized modification, use of unsuitable mounting structures or hardware, failure to inspect or maintain the product, or other misuse of the product, except to the extent liability cannot lawfully be excluded or limited.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law, including any liability that cannot legally be waived.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Colyvee and its owners, employees, agents, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or misuse of a Colyvee product.

This provision does not apply to the extent a claim results from conduct for which Colyvee is legally responsible.

15. Privacy

Your use of our website is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information.
